MALINDA LUGO practices in the firm’s health law and litigation departments. Her practice includes representing physicians, physician groups, hospitals, home health agencies and other health care providers on issues related to state and federal health care matters including regulatory and licensure compliance, electronic health records, patient privacy (HIPAA) compliance and breach investigations, medical staff matters including peer review and physician credentialing, and licensure defense actions. Malinda advises her clients on an array of civil matters including negotiation of employment, electronic health and IT vendor contracts, implementation of legal hold policies, electronic discovery and other general litigation.
Prior to joining Shumaker, Malinda spent over a decade defending physicians, hospitals and other health care providers in medical negligence actions. Utilizing her expertise in this area, she frequently advises healthcare providers on risk management issues including appropriate documentation, informed consent, supervision of physician extenders, and retention policies for electronic health information. She also serves as personal counsel for health care providers involved in negligence actions.
