Understanding the emotional difficulties associated with complex litigation, Dan is known for giving clients trusted advice in the case at hand, and in life. Corporate clients from a variety of industries turn to him for his extensive experience in commercial and business litigation, fidelity and surety law, wrongful-death and severe personal injury litigation, and construction law.

In practice for more than two decades, which included many jury trials, bench trials, and arbitrations, Dan represents businesses of all sizes in a variety of legal disputes and commercial transactions. A diplomatic problem-solver, he devotes approximately sixty percent of his practice to surety and construction law, representing sureties, contractors, owners, and construction materials manufacturers, including window manufacturers in commercial and residential claims, both in federal and state courts throughout the Southeast. Dan’s ability to remain diplomatic and solve complex problems also allows him to successfully represent clients in matters, including:

  • Shareholder disputes
  • Broker-dealer litigation
  • Non-compete litigation
  • Insurance bad faith litigation
  • Coverage disputes
  • Agriculture related disputes
  • Representation of local governments and nonprofit organizations
  • High value wrongful death and personal injury claims

Outside the courtroom, Dan is deeply devoted to his family and enjoys spending time with them on his “mini” farm.

Representative Matters

  • May 9, 2018. Successfully opposed appointment of receiver in complex business break-up suit. 759 Ventures, LLC v. GCP Apartment Investors, LLC, case no. 17-CVS-4138, 2018 WL 2138727.
  • Aug. 2017. Defeated all claims against surety by owner-obligee in multi-million dollar three-judge private arbitration where surety had denied owner-obligee’s performance-bond claim.
  • 2010. Excluded experts and obtained summary judgment in multi-million dollar products-liability case. Snoznik v. JELD-WEN, INC., 2010 WL 1924483 (W.D.N.C.). 
  • 2008. Negotiated $4 million settlement for traumatic-brain injury victim (details confidential).
  • 2007. Achieved $2.64 million settlement with taverns for wrongful-death victims even though there were no eye-witnesses who would testify that they saw the drunk driver being served alcohol while intoxicated.
  • Oct. 2, 2007. Overturned summary judgment in reported decision: Park East Sales, LLC v. Clark-Langley, Inc., 186 N.C. App. 198, 651 S.E.2d 235 (2007), rev. denied, 362 N.C. 360, 661 S.E.2d 736 (2008). http://caselaw.findlaw.com/nc-court-of-appeals/1040149.html.
  • Dec. 1, 2000. Obtained highest soft-tissue injury jury verdict in county history, per judge presiding in: Dr. Stephen R. Byrd v. Moddassir M. Ali, Davidson County Superior Court, case no. 99-CVS-2352.
  • Aug. 1, 1997. Overturned summary judgment for Defendant. Margaret DIEHLMAN, Appellant v. Steven M. Braunfels d/b/a Tom's Donuts, Appellees, no. L-96-357.
